Business Terms and Conditions

The following conditions apply to all businesses placing entries with FOXY Choice.
Find out about information relating to our website terms of use.

Please read these terms carefully before you agree to them as part of your application for an entry, particularly the 'Prices and Payment section' and 'Your Responsibilities'. If you are not happy with these terms and conditions, please do not place an entry with FOXY Choice.

Definitions

The Agreement to include the application form, the latest rate schedule, any direct debit form (if applicable), these terms and/or any variations agreed between the client and FOXY Choice in writing.

The Application Form completed by the Client, this states contact details, search categories and applicable garage services, customer services, facilities and quality awards, depending on the FOXY Choice package purchased.

The Client (you) the person named on the application form who is the signatory of any agreement, either for one business or many within a group or network and who wishes to purchase one or more entries.

The Subscriber the business detailed in the application form and entitled to the marketing services described, depending on whether it is a Bronze, Silver or Gold package.

The Entry the agreed entry within the FOXY Choice website detailed in the application form; with the style and content depending on whether it is a Bronze, Silver or Gold package.

FOXY Choice (we/us) the owner of this website and a trading name of FOXY Drivers Ltd, a Company registered in England and Wales No 5071266 and registered for VAT, number 841 3841 35.

The FOXY Promise all businesses placing an entry agree to the FOXY Promise which states "We strive to be a female friendly garage and will never knowingly overcharge, patronise or sell our customers services they do not need or want".

The Rate Schedule the latest published price list detailing the content of FOXY Choice Bronze, Silver and Gold packages.

Prices and Payments

All prices are quoted in the latest FOXY Choice rate schedule and are subject to change without notice.

All prices are subject to VAT.

Entries must have been paid for in advance before they appear.

ATA employers, BSI Kitemark holders and members of an OFT approved code scheme qualify for a 20% discount on all 12 month agreements.

We will be entitled to withhold publication of your entry if you fail to make payment in accordance with our agreement.

Your responsibilities

The information you supply in the application form about garage services, customer services and facilities must be accurate, legal, honest and truthful.

You must own or have authority to use any trade name, trademark, quality assurance status or logo in your FOXY Choice entry. For example, the OFT Approved code logo may not be used, copied or reproduced in whole or in part or in any manner or form unless the Client has been granted an Approved code logo licence by the Office of Fair Trading. If you state you are a member of a trade body your subscription must be up to date. Consumer Protection from Unfair Trading Regulations was introduced on 26 May 2008 and any trader using unfair and/or misleading commercial practices, such as claiming accreditation falsely will be in breach of these regulations.

You are responsible for maintaining the accuracy of all customer contact information and informing FOXY Choice of any amendments during the course of your agreement.

A business entry in FOXY Choice requires that you agree to the FOXY Promise and 'strive to be a female friendly business'. This does not confer any FOXY-related female friendly accreditation or imply that your business has been endorsed by FOXY.

You are permitted to use FOXY-related logos (FOXY Lady Drivers Club, FOXY Choice or FOXY Promise) to promote the Subscriber, as stated in the Subscribers Area.

You are not permitted to use FOXY Choice's marketing materials or FOXY-related logos (FOXY Lady Drivers Club, FOXY Choice or FOXY Promise) to promote any business that is not a Subscriber, even when that business is part of the same or an associated business group.

You are not permitted to use other text from the FOXY Choice or FOXY Lady Drivers Club websites unless you have been given prior permission in writing by FOXY.

You acknowledge and accept that computer systems do occasionally require maintenance and/or upgrades when our website might be temporarily unavailable for the shortest period of time, as necessary.

You shall indemnify us, any employees and agents against all proceedings, claims, expenses, losses and/or damages arising from any breach of this Agreement by you, including any claims arising as a result of defamation, illegality, misrepresentation, false description or breach of any third party rights.

You will supply any suitable photograph and/or business logo to appear in a Gold Package entry; either as a quality jpg/png/gif or tif file to photos@foxychoice.com or by posting one to FOXY Choice, 35 Goring Road, Steyning BN44 3GF.

Our responsibilities

We will check all applications for data and spelling mistakes to the best of our ability.

We will ask you to approve your entry before this appears live PROVIDING this can be done by email.

We do not accept responsibility for incorrect or revised email or website addresses where you have failed to provide this detail correctly or update it.

We display the number of visitors to each FOXY Choice Silver and Gold website page.

We undertake to promote the UK's 'best and female friendly garage services' online by using a combination of search engine optimisation and marketing methods.

Should we decide not to publish an entry or banner advertisement for any reason, you will be entitled to a full refund of any money you have paid but you will not be entitled to any other compensation or damages.

In extreme circumstances we will de-list a business, including proven instances of shoddy workmanship where safety issues were compromised, and wherever a total of three written complaints are made about the same business; illustrating an evident 'couldn't care less' attitude towards the customer. In such circumstances no refund of monies paid will be made.

Cancellation rights

In addition to any statutory rights, you may cancel your agreement with FOXY Choice within 14 days of the date of the application form. Entries cannot be cancelled after this 14 day period unless this is in accordance with any statutory rights.

Our liability

If there is an error made in your displayed entry please advise us as soon as possible so this can be rectified. We will not be liable for any direct, indirect or consequential loss or damage arising from any mistake made or material missing from the published entry, even if resulting from our negligence.

Colour Advertisements

The colour of any logo and/or photograph in an online entry may not match the precise colour(s) of this on paper. This does not constitute an error and you will not be entitled to any refund or other remedy in respect of any differences in colour(s).

This Agreement

This Agreement sets out the understanding between you and us when you complete an application for an entry with FOXY Choice. This will replace any previous agreement, arrangement and understanding between us in future.

Any variation to this agreement must be agreed in writing between you and us before any entry appears.
